These Terms of Service ("Terms") govern your access to and use of the zFairs companion mobile application (the "App"), including any related services, features, content, and updates provided by zFairs (referred to as "we", "us", or "our"). The App serves as a companion for events managed through our platform, offering real-time event information, updates, push notifications, schedules, maps, and other event-related features.
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download, install, or use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device you own or control, solely for your personal, non-commercial use in connection with events you attend or participate in. This license is conditioned on your compliance with these Terms.
In the standard App version, you must select your event to access relevant information. Some clients may deploy a custom-branded version of the App tied to their specific event, which pre-configures access without event selection.
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others or restrict/interfere with the App's use by others. Prohibited activities include, but are not limited to:
Certain features may require you to create an account or provide information (e.g., name, email). You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.
If you enable push notifications or location services, you consent to receiving event-related alerts and location-based features (e.g., maps, nearby sessions). You can manage these permissions in your device settings at any time.
The App provides information supplied by event organizers/clients. We do not verify or endorse this content and make no warranties about its accuracy, completeness, or timeliness. Event details, schedules, and updates may change; use the App at your own risk.
The App, including its design, text, graphics, code, and features, is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.
The App may integrate with third-party services (e.g., push notification providers like Firebase/APNs, mapping services). Your use of those services is governed by their terms and policies. We are not responsible for third-party content or practices.
We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. You may stop using the App at any time by uninstalling it.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE PRECEDING 12 MONTHS.
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
We may update these Terms from time to time. We will post the revised version here and update the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms. For material changes, we may provide in-app notice.
These Terms are governed by the laws of the State of [e.g., Utah], without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in [e.g., Davis County, Utah].
